Ellen A. Scordino

Ellen Scordino is a seasoned intellectual property and commercial litigator with two decades of experience in BigLaw guiding life sciences, health tech, and diagnostics companies through high-stakes disputes and complex IP strategy. She counsels C‑suite executives, boards, and senior leaders on how to protect innovation, manage risk, and align IP and litigation strategy with business objectives, budget, and timelines.
 

Drawing on her background as a research scientist, Ellen brings a deep understanding of drug development, regulatory pathways, and the science behind her clients’ products. She is known for her practical, business-first approach, proactive issue spotting, and ability to design creative, cost‑effective solutions that protect IP assets and support commercialization.

Areas of Focus

I.  IP Strategy & Portfolio Development 
Ellen develops and executes global IP strategies that support product development and market access. She designs multi-tiered patent protection programs — including broad and targeted claim drafting and international filing plans — for current and next-generation products. Her work includes patent landscape reviews, freedom-to-operate analyses, and validity assessments, as well as counseling on AI and emerging technologies, regulatory exclusivities, and the interplay between IP and market access for pharmaceutical and biologic products.

II.  Licensing & Transactions 
Ellen advises on IP and regulatory matters across the full range of business development and investment activity, including licensing, joint development, research and collaboration, and commercial agreements. She has deep experience with due diligence for strategic transactions, with a focus on patents, trade secrets, antitrust, and regulatory risk. Her practice also encompasses structured finance transactions, royalty acquisitions, and the identification and monetization of undervalued IP assets in partnership with boards, investors, and management teams.

III.  Litigation & Disputes 
Ellen has led teams through all stages of complex IP and commercial disputes, including offensive and defensive patent litigation in U.S. district courts, post-grant proceedings before the PTAB, and matters before the ITC. She has extensive experience in BPCIA and Hatch-Waxman litigation, as well as inventorship, licensing, trade secret, employment, and royalty disputes. She regularly manages large, fast-moving dockets and coordinates global strategies, including parallel proceedings outside the United States.
